Welcome to the Online Photobooks website (the "Site") provided by Online Photobooks Pty Ltd ("Online Photobooks",
"we", "us" and "our") ABN 14 001 044 631, New South Wales, Australia. By accessing the Site you accept and agree
to the Terms and Conditions set out below. These Terms and Conditions may be updated or changed by us from time
to time so please take the time to check and read them each time you access the Site.
Your acceptance of these Terms and Conditions creates a binding legal agreement between you and Online
Photobooks pursuant to which you agree to comply with these Terms & Conditions and use the Site only in a manner
consistent with these Terms and Conditions. If you do not agree with these Terms and Conditions, access to the
functions of the Site and use of the Site will not be granted.
Disclaimer of Warranty, Limits of Liability and Indemnity
Online Photobooks is not liable to you for any loss you suffer in connection with your access or use of the Site, any
linked website or any software available at the Site.
To the extent permitted by applicable law, we disclaim any and all implied warranties or conditions, including any
implied warranty of title, non-infringement, merchantability or fitness for a particular purpose, regardless of whether
we know or had reason to know of your particular needs. No employee, agent, dealer or distributor of ours is
authorized to modify this limited warranty, nor to make any additional warranties.
Where legislation implies in these Terms and Conditions any condition or warranty and that legislation prohibits a
contract excluding liability under such condition or warranty, the condition or warranty shall be deemed to be
included in these Terms and Conditions.
However, our entire liability and your exclusive remedy for breach of such condition or warranty shall be limited, at
our option, to either repairing or replacing the product that does not meet the warranty or condition (if it is returned
to us) or the price paid by you to us for that product or service.
In no event will we be liable to you for any damages, including any lost profits, lost savings, or other incidental or
consequential damages arising from the use of the site (even if we or an authorized dealer or distributor has been
advised of the possibility of these damages), or for any claim by any other party.
If you breach these Terms & Conditions you agree to fully indemnify us for any loss we may suffer.
Refund/Returns Policy
Online Photobooks P/L (OPB) holds in the highest regard the satisfaction of our customers and will attempt to resolve any problems or dissatisfaction they may have with the products and services we provide.
Any problems or defects in the quality of the products and services provided by OPB should be reported to us as soon as practically possible after receiving the goods. OPB will undertake the replacement of any items faulty through the manufacturing process and should this not be possible, a full refund will be issued.
The cost of returning faulty items to OPB will be the responsibility of the customer and just as the cost of returning any replaced items will be covered by OPB.
Contained within this website are a set of guidelines designed to assist customers in understanding the photobook design and production process and to maximize the quality of the finished product/s.
OPB take no responsibility for mistakes or faults resulting from design work not adhering to these best practice guidelines.
Delivery
All goods will be shipped to the delivery/shipping address provided by the customer at time of purchase (or registration).
OPB will undertake to process all orders within 10 working days of receipt. Should our production staff encounter any problems with an order the customer will be contacted as soon as possible after the detection of the problem.
OPB accept no responsibility for any orders not processed within the specified time frame through circumstances beyond OPB’s control. Likewise, OPB accept no liability for any losses incurred by the customer in these circumstances.
Third Party Software and Links
The Site may require the use of some third party software – e.g. Adobe Acrobat PDF, Macromedia Flash Player and
ActiveX. Links are provided for downloading any relevant free software.
While we host the Site, some material may be available on the Site that has been contributed by others. We do not
make any representations or promises about or endorse any other content, software or websites that may be
accessed from this Site and we are not responsible for any content, services or software available from these linked
sites including without limitation the quality, accuracy, merchantability or fitness for purpose of any material on other
websites to which the Site is linked.
Ownership of content on the Site
Unless specifically stated otherwise, all components of the Site, including all text, graphics, photos and software (the
"Content") are protected by copyright and other intellectual property rights and are owned by Online Photobooks.
You may not modify, copy, reproduce, transmit or distribute the Content without Online Photobooks's prior consent.

This Site is an Australian website and your access to and use of the Site is subject to the laws of New South Wales,
Australia and the parties submit to the exclusive jurisdiction of the courts of that state. You must ensure that your
